How to Check and Clear an Absconding Case in UAE From Abroad

An absconding case in UAE is an employer’s report to the Ministry of Human Resources and Emiratisation (MOHRE) that a worker stayed away from work for more than seven days without a valid reason. For mainland jobs, it can only be filed while the worker is still in the UAE. Once approved, it cancels the work permit and blocks a new one for a year.

For anyone now living in the USA, UK or Europe, the real question is simpler: is there anything on your file that could stop you at a UAE airport? This guide explains how absconding reports work under the current law, how to check for one from abroad, and what to do before you book a flight.

What Is an Absconding Case in the UAE?

An absconding case is the everyday name for what MOHRE now calls an “absence from work” complaint, also known as an absconding report or a work abandonment report. It is a labour record filed by an employer. It is not a criminal charge.

The rules come from the UAE Labour Law, Federal Decree-Law No. 33 of 2021, in force since 2 February 2022, together with Cabinet Resolution No. 1 of 2022 and Ministerial Resolution No. 47 of 2022. These replaced the old labour law from 1980. This matters because a large share of what you will read online, including many forum answers, still describes the old system.

How an Absconding Report Differs From a Travel Ban

An absconding report mainly affects your right to work in the UAE. A travel ban is a separate restriction linked to an open financial, civil or criminal matter. It stops you from leaving the UAE and can surface when you return or transit.

The two can exist side by side. For example, someone who walked away from a job and also left behind an unpaid credit card can have an absconding report on the labour side and a debt case on the other. Each record sits with a different authority and has to be checked separately. For a full breakdown of the different types of restriction, see our guide on how to check a UAE travel ban by passport number.

When Can an Employer File an Absconding Report?

An employer can file an absconding report when a worker has been absent for more than seven consecutive days without a lawful reason, and the employer does not know where the worker is or cannot reach them. For mainland companies, the report goes to MOHRE. Free zone companies report through their own free zone authority.

According to MOHRE’s official service conditions, all of the following must apply:

  • The absence lasted more than seven days.
  • The absence took place inside the UAE.
  • The employee was present inside the UAE.
  • The employer attaches an entry and exit movement report from the Federal Authority for Identity, Citizenship, Customs and Port Security (ICP), no older than 30 days.

Can an Employer File an Absconding Case After You Left the UAE?

For a mainland job, generally no. MOHRE’s service requires the absence to take place inside the country and the employee to be present inside the country, and it is backed by an ICP movement report that shows where the worker is. Once your exit from the UAE is recorded, the mainland absence service no longer fits your situation. DMCC’s free zone guidance says the same: employees outside the UAE cannot be reported as absconders.

There are two important cautions:

  1. A report filed before you left still stands. Many people stop going to work for a week or two, then fly out. By then, the report may already be on file.
  2. Leaving does not close other claims. An employer can still pursue an unpaid loan, a cheque or a complaint about company property through other channels, and those are the matters that can lead to a travel ban.

What Happens After an Absconding Report Is Approved?

Once MOHRE approves an absence report, the work permit is cancelled automatically. Under the Labour Law, the worker cannot be given a new UAE work permit for one year from the date of the absence. During that year, any other employer who knows about the report is not allowed to hire the worker.

How Long Does an Absconding Ban Last in the UAE?

Under the current law, the absconding ban lasts one year. It counts from the date the absence started, not from the date you left the UAE. It applies only where the report is found to be true. For example, if the absence began on 1 March 2026, the ban on a new work permit runs until 1 March 2027.

It is not a lifetime ban under the current rules. Older articles and forum answers that describe longer bans usually rely on rules that were replaced in 2022.

On its own, this labour ban limits working in the UAE. It is not an entry ban. Problems at the border come from other records, which are covered below.

Is an Absconding Case a Criminal Case?

Not under the current labour rules. The Labour Law and its regulations attach administrative consequences to an absence: the work permit is cancelled, and a new one is blocked for a year. They set no criminal penalty on the worker for the absence itself.

The picture changes when an employer files a separate complaint, for example alleging that money or company property was taken. That is a criminal matter, handled by different authorities, and it can lead to a travel ban. This is why the absconding report is often not the real risk for someone abroad. A second case connected to it can be.

Free Zone Absconding Cases and Airport Flags

Free zone employees are reported through their free zone authority rather than MOHRE, and in at least one major free zone this has a direct effect at the border. DMCC’s official absconder guidelines state that once an absconder notification is processed, ICP flags the employee’s name, and the employee can be stopped when trying to leave or enter the country. In JAFZA, declaring an absconder runs through a report to GDRFA Dubai.

For example, someone who worked for a DMCC company in Jumeirah Lakes Towers and left without notice could face a border flag that a mainland worker in the same situation might not. Knowing which authority issued your work permit, MOHRE or a free zone, is the first step in judging your risk.

How to Check if You Have an Absconding Case From Abroad

You are not usually told when an absconding report is filed against you. Most people find out when they apply for a new UAE job, a visa or a flight. Online services are built around UAE Pass and resident records, and a labour report, a free zone flag and a travel ban sit with different authorities. One search therefore rarely gives the full picture, especially from abroad.

We check with the relevant authorities using your passport number and confirm whether a travel ban or other restriction is recorded against your name, so you know where you stand before you travel. You do not need to come to the UAE for the check.

Signs your former employer may have filed a report:

  • You stopped going to work for more than a week before leaving, without resigning or agreeing an exit.
  • Your work permit was cancelled without a cancellation you signed.
  • You left during a dispute over salary, notice or company property.
  • Your former employer, a colleague or a recruiter mentioned a report.

What we need from you to run the check:

  • A copy of your passport
  • Your previous UAE visa number and Emirates ID number, if you had them
  • Your older passport, if your UAE visa was stamped in it
  • A copy of your last UAE exit stamp
  • The name of your former employer and your last working day

How to Remove an Absconding Case in the UAE

An absconding case is removed by having the report cancelled. The employer can withdraw it, or MOHRE can cancel it on recognised grounds. MOHRE’s cancellation service is open to either party to the employment relationship, and the ministry says it processes requests within 14 working days.

The grounds MOHRE recognises include:

  • The absence did not actually exceed seven consecutive days.
  • There was a legitimate reason for the absence, such as illness.
  • The worker was at work or on approved leave.
  • The employment had already ended by agreement, or the employer had allowed the worker to stop work.
  • The employer agrees to resolve the matter.

Because the one-year work permit ban applies only where the report is found to be true, a cancelled report should not carry the ban. Free zone reports follow the free zone authority’s own process.

Remember that cancelling an absconding report does not clear a separate debt or criminal case. When another matter sits behind a restriction, see our guide on how to remove a travel ban in the UAE.

Can You Return to the UAE With an Absconding Case?

Often yes, but it depends on what else is on your file. A mainland absconding report on its own is a labour record: it limits new work permits for a year rather than barring entry. A free zone absconder flag, an entry ban, or a separate debt or criminal case is what can stop you at the border.

Deportation is a separate matter. Under the UAE Entry and Residence of Foreigners law, Federal Decree-Law No. 29 of 2021, a person who has been deported cannot return without permission from the relevant authority.

Visiting on a Tourist Visa

A tourist visit does not need a work permit, so the one-year labour ban does not by itself stop a visit. What matters is whether your name is flagged with immigration or linked to an open case.

For example, a UK national who left a mainland Dubai job in 2025 and settled every debt before flying out is in a very different position from someone who left a free zone job with an unpaid loan. Only a check of both records shows which of the two applies to you.

Transiting Through Dubai

A short airside connection is different from a layover that takes you through passport control, and a flag on your record matters most when you pass through immigration. A delayed or missed connection can change your situation without warning. Our guide on whether you can transit through Dubai with an old UAE case covers the risks in detail.

Absconding Case UAE: Frequently Asked Questions

How do I know if I have an absconding case against me in the UAE?

Usually you are not notified. The common signs are leaving work for more than a week without an agreed exit, a work permit cancelled without your signature, or leaving during a dispute with your employer. The reliable way to know where you stand is to have your status checked before you apply for a UAE job or book a flight.

Can my employer file an absconding case while I am outside the UAE?

For a mainland job, generally no. MOHRE’s absence service requires the absence to take place inside the UAE and the employee to be present in the country. DMCC’s guidance also says employees outside the UAE cannot be reported. A report filed before you left, however, remains on record.

Is an absconding ban lifetime?

No. Under the current UAE Labour Law, the ban on a new work permit lasts one year from the date the absence started, and only where the report is found to be true. Longer bans described online usually come from rules that were replaced in 2022.

Does an absconding case expire?

The one-year work permit ban runs out on its own. A related travel ban, entry ban or open case does not expire with time. It stays until the matter behind it is resolved and the removal is processed.

Can an absconding case be removed without the employer?

Yes. MOHRE’s cancellation service is open to either party, and the ministry can cancel a report on recognised grounds, such as an absence shorter than seven consecutive days, a legitimate reason, approved leave, or an employment that had already ended by agreement.

Can I check an absconding case without an Emirates ID?

Online services are built around UAE Pass and resident records, which leaves many people abroad without a complete answer. We check with the relevant authorities using your passport number and confirm whether a travel ban or other restriction is recorded against your name.

Can I visit the UAE on a tourist visa after an absconding case?

Often yes, because the one-year labour ban applies to work permits, not visits. A free zone absconder flag, an entry ban or a separate debt or criminal case can still stop you at the border, so check your status before you travel.

Is absconding a criminal offense in the UAE?

No. The current labour rules attach administrative consequences, permit cancellation and a one-year work permit ban, and set no criminal penalty for the absence itself. A separate complaint, for example over money or company property, is a criminal matter and can lead to a travel ban.
