WhatsApp messages can be used as evidence in UAE debt claims, and UAE judges have relied on them to order repayment of loans from AED 57,000 to AED 480,000. Under Federal Decree-Law No. 35 of 2022, the UAE Law of Evidence, electronic correspondence is accepted as evidence, and a copy or screenshot carries the same weight as the original as long as it matches the record. What decides a case is not the app but what the messages say. A clear admission of the amount owed, linked to a bank transfer, is strong evidence. A vague chat with no figures often is not.
This guide explains how WhatsApp messages as evidence in UAE debt recovery cases are treated today, the AED 50,000 rule that catches many lenders out, what recent cases show, and how to preserve your chats properly from the USA, the UK or Europe.

Are WhatsApp Messages Valid Evidence in the UAE?
Yes. The UAE replaced its old evidence law in 2022, and the new law deals with digital proof directly. That matters, because much of the guidance still circulating online was written under rules that no longer apply.
What the UAE Law of Evidence Says About Electronic Messages
Federal Decree-Law No. 35 of 2022 has a dedicated part on electronic evidence. It covers information that is generated, stored, sent or received through technology, as long as it can be retrieved in a readable form, and it names electronic correspondence and modern means of communication among the accepted types.
Electronic evidence generally carries the same value as a private written document. The law also treats it as valid against the parties when it comes through an authenticated or publicly available electronic means, unless the other side proves otherwise. It works alongside Federal Decree-Law No. 46 of 2021 on electronic transactions, which recognises agreements and documents created electronically.
Do Screenshots Count, or Do You Need the Original Chat?
Screenshots count. Under the 2022 law, an extract of electronic evidence has the same value as the original, provided it matches the electronic record.
The original still matters, though. The judge can ask for the conversation itself to check that it is genuine, and a party who refuses to produce it without an acceptable reason can lose the right to rely on it. A full chat export, kept together with the phone that holds the conversation, is far stronger than a handful of cropped images.
Who Has to Prove a WhatsApp Message Is Fake?
The person who disputes it. The law puts the burden on the party claiming that electronic evidence is invalid, and the challenge follows the rules on forgery. Simply saying “I never sent that” is not enough.
UAE mobile numbers are registered to an identity document, which makes it hard for a borrower to deny owning the number the messages came from. Where authenticity is genuinely in doubt, the judge can appoint a technical expert to examine the chat.
Recent UAE Cases Where WhatsApp Proved a Debt
WhatsApp evidence is not a theory. Gulf News reported several debt cases in 2025 and 2026 in which chats decided the outcome:
- AED 480,000 (Dubai): The borrower admitted the debt in WhatsApp messages and even proposed a repayment plan by text. He was ordered to repay the full amount with interest.
- AED 330,000 (Abu Dhabi): The lender relied on WhatsApp conversations showing the loan, and the borrower produced nothing to dispute it. After an oath, he was ordered to repay the full sum plus damages for the delay.
- AED 233,000 (Abu Dhabi): Money handed over in cash for a joint project was proven through electronic evidence, including WhatsApp messages, after the judge appointed a technical expert to examine the matter.
- AED 57,000 (Dubai): Messages demanding repayment were treated as prima facie written proof, and together with a supplementary oath they led to an order for two brothers to repay jointly.
What the Successful Claims Had in Common
In each case, the messages clearly related to the money in dispute, and the judges accepted them as genuine. Each claim also had something more: the borrower’s own admission of the debt, an oath, or a technical expert’s review.
Why One WhatsApp Claim Failed
In 2025, an Abu Dhabi claim for AED 25,000 was dismissed even though the money had been transferred. The money had been sent towards a car purchase, but the WhatsApp and social media messages never clearly referred to that deal. The lesson is simple: a transfer on its own does not prove a debt, and messages that do not link the money to an obligation to repay will not fill the gap.
The AED 50,000 Rule and Why It Matters for WhatsApp Evidence
Under the 2022 Law of Evidence, any transaction worth more than AED 50,000 must be proven in writing, and witness testimony alone cannot establish it. Many overseas lenders, especially those who lent to friends, relatives or business partners on trust, have nothing in writing except their chats. This is where WhatsApp becomes decisive.
How a WhatsApp Message Can Count as Written Proof
The law allows other evidence above the threshold where there is a documentary principle, meaning some written evidence that makes the claim likely. A message from the borrower saying “I will return the AED 200,000 by March” is exactly that kind of written starting point.
The law also recognises situations where a material or moral reason prevented anyone from putting the loan in writing. It expressly treats a relationship between spouses, or by blood or marriage, as a moral impediment, which matters when money was lent within a family.
When an Oath Completes the Proof
Where the written evidence is strong but not complete, the judge can direct a supplementary oath to one of the parties. That is how the AED 57,000 case was concluded. An oath is a serious step, and whether it is appropriate depends on the facts, which is one reason to have the evidence reviewed before anything is filed.
Which WhatsApp Messages Make a Strong Debt Claim
Messages That Admit the Debt
The strongest messages come from the borrower and do one or more of these things:
- state or confirm the amount, even approximately
- promise repayment or propose a schedule
- apologise for the delay or ask for more time
- reply to your demand without denying the debt
Even a short reply such as “I know, I’ll pay you next month” can matter, because it acknowledges that the money is owed.
Messages That Weaken Your Claim
- messages with no amount and no reference to paying anything back
- chats that describe the money as a gift, as “help”, or as a share in a business, with no mention of returning it. Money paid as an investment follows different rules, covered in our guide to recovering investment money in Dubai
- jokes or replies that could reasonably be read more than one way
- your own angry or insulting messages, which can create problems of their own under UAE law
Voice Notes, Deleted Chats and Messages From Another Number
- Voice notes: the law covers electronic media and other electronic evidence, so voice notes can be used. They need a transcript and a translation, though, and a clear written message is always easier to rely on.
- Deleted chats: a message deleted on one phone may still exist on yours, in a backup or on the borrower’s own device, and a technical expert can sometimes recover deleted data. Never delete anything yourself, even to tidy up a conversation.
- Another number: messages from a number the borrower does not obviously own need extra proof that he sent them, such as the same number appearing in his transfers, other correspondence or his own admission.
Why Bank Transfers and WhatsApp Messages Work Best Together
A bank transfer proves the money moved. WhatsApp proves why it moved.
On its own, a transfer can be explained away as a gift, a payment for something else or a share in a project, which is exactly what sank the AED 25,000 claim. On their own, messages can be attacked as vague. Together, a transfer receipt that matches the amount and date discussed in the chat makes a debt very hard to deny. In our debt recovery work, bank transfer receipts are the strongest evidence a lender can bring, and we pair each one with the messages that explain it.
How to Preserve WhatsApp Evidence From the USA, UK or Europe
Export the Full Chat With Dates and Numbers
Use WhatsApp’s built-in export to save the whole conversation, including media, and keep the file somewhere safe. Take screenshots of the key messages as well, with the contact’s number, the date and the time visible. Do not crop, annotate or edit anything.
Keep the Original Phone and a Backup
Keep the phone that holds the conversation, do not reset it, and turn on a cloud backup. Changing phones is fine as long as the full chat history moves with you. The original record may be needed if the borrower challenges the messages.
Match Every Message to a Transfer Record
Download the bank statements or transfer confirmations for every payment, and note which message relates to which transfer. A simple timeline of dates, amounts and matching messages saves time and makes the claim far easier to follow.
From WhatsApp Chat to Legal Notice and Recovery
Once the evidence is organized, the usual first step is a formal legal notice demanding payment, which we prepare within 2 to 3 working days. Many debtors settle at that stage, with negotiations handled by email while you stay abroad.
Where they do not, the claim moves to formal proceedings, and after a judgment, a travel ban can be requested to stop the debtor leaving the UAE while the debt is unpaid. The full process is set out in our guide to recovering a debt from Dubai while living abroad, and our debt recovery Dubai service covers every stage.

FAQs About WhatsApp Messages as Evidence in UAE Debt Claims
Are WhatsApp messages valid evidence in the UAE?
Yes. Federal Decree-Law No. 35 of 2022, the UAE Law of Evidence, accepts electronic correspondence and modern means of communication as evidence. WhatsApp messages have been used in several recent debt cases to order repayment, provided they clearly show the debt and come from the borrower.
Is a screenshot of a WhatsApp chat enough?
A screenshot is accepted if it matches the original record, because the law gives an extract the same value as the original. It is still best to keep the full chat export and the phone that holds the conversation, in case the borrower challenges the messages.
Do WhatsApp messages need to be translated into Arabic?
Yes. UAE proceedings are conducted in Arabic, so chats in English or another language need a certified legal translation before they are filed. We arrange the translation as part of the case, so you do not have to handle it yourself.
Can I recover a loan over AED 50,000 with only WhatsApp messages?
Often, yes. Transactions above AED 50,000 must be proven in writing, but a message in which the borrower admits the debt or promises to repay can act as that written evidence. Combined with transfer receipts, and sometimes an oath, it can be enough to prove the loan.
What if the debtor says the messages are fake?
The burden is on the person who says the messages are fake, and the challenge follows the rules on forgery. Because UAE mobile numbers are registered to an identity document, denying ownership of the number is difficult, and a technical expert can be appointed to examine the chat.
What if the debtor deleted the chat?
Deleting a chat on the borrower’s phone does not remove your copy. Your own phone, an exported chat file or a backup can all be used, and a technical expert can sometimes recover deleted data. Never delete anything on your side.
Are WhatsApp voice notes accepted as evidence?
Voice notes fall within electronic evidence under the 2022 law, so they can be used. They need a transcript and an Arabic translation, and their weight depends on how clearly they refer to the debt. A written message saying the same thing is usually stronger.
Can I use WhatsApp evidence if I live outside the UAE?
Yes. You can export your chats and transfer records from anywhere and send them to us. We handle the legal notice, translation and filings in Dubai, so lenders in the USA, the UK and Europe do not need to travel to the UAE.
This guide gives general information about UAE law as of October 2026 and is not legal advice. Whether WhatsApp messages are enough to prove a particular debt depends on what they say and the other evidence available, so speak to a lawyer before you file a claim or send a demand.
